1. DEFINITION

Items : Ready-to-wear and sports items (all families of items present) offered ("added" to the Site) by Members for sale or purchase on the Site. Any Item offered for sale must be in one of the following states:

• Like new - Almost new with no signs of wear
• Very good condition - Only shows minor signs of wear
• Small defects - Has small defects (holes, seams, cuts, etc.) always specified in the product sheet.

Colissimo voucher: Parcel Colissimo label generated by the YUJ Paris teams when a Member sends one or more Items. In the case of a purchase, delivery is free if the delivery address is in France and if the package is less than one kilo.

Sending form: In order for the item to be authenticated and eligible for trade-in, the member must complete a sending form. This sending form is available at the stage of sending the article. The sending form must be in the name of the Member and must include the condition of the article and the signature of the Member. Otherwise, the submission form will be null and void. Upon receipt, the sending form is kept for 90 days (except in the event of a dispute or it is kept until its expiry).

Parcel: Item(s) purchased or exchanged on the Site, accompanied by its shipping slip printed and pasted correctly on the packaging and which is intended to be delivered to La Poste for shipment to the recipient during a purchase or at YUJ Paris during an exchange. A package must be carefully packaged and the Item must be in the state in accordance with its description on the Site and washed.

Order: refers to any order placed by the member registered on this Site

Member Account: means the account of a Member created through the registration of said Member having previously provided a valid e-mail address and a password. Through his Member account, the Member can buy or exchange Items.

General Conditions of Sale and Use or "CGV/CGU": designate these general conditions of use and online sale;

Exchange: When a Member sends their Fashion Items directly to the Site in exchange for a credit or a promotional code, this is referred to as an Exchange.

Member: means, in the singular or plural, a natural person likely to use the Website after registration (valid e-mail address) and acceptance of these General Conditions of Service. All Members agree to provide accurate information regarding their identity, address and other data necessary for accessing and using the service and to update any changes to this information. To benefit from the services offered by the Website, all Members must have their residence in metropolitan France, including Corsica. Each Member is both sender when exchanging Items and receiver when purchasing Items.

Packaging rules:

Dimensions of the Parcel: it is the responsibility of the Member not to exceed the maximum dimensions (the sum of the length, width and height must be less than 120 cm).

Weight of the Package: it must correspond to the weight of the advertised Article and must not exceed 20 kg in the case of delivery via relay points.

The packaging of the Parcel must secure the contents and allow handling and movement without risk for its integrity, but also for the safety of the transport personnel. In the event that a Member does not comply with these packaging rules, the Carrier may refuse the package, at its sole discretion.

Company: refers to the Company YUJ-YOGA WITH STYLE

Site: represents both the company YUJ-YOGA WITH STYLE and its services distributed on the site yuj.fr

Carrier: On the Site only one operator is offered to exchange its Items, it is the Colissimo service of La Poste (free delivery in the case of an exchange). To purchase Items, the Site offers the same service for home delivery. For all specific requests (express delivery, etc.), contact support to benefit from a tailor-made solution.

Acceptance of a Parcel by the Carrier does not constitute acceptance of the compliance of the packaging with the rules indicated above.

In the absence of non-compliance with these rules, a Member is liable to pay the additional cost and to collect the Parcel at his own expense, which the Member now accepts.

Value or take-back offer of the Item: means the amount indicated in credit on the Site for the recovery of an Article at the time of entry on the Site in the exchange section. The Member obtains an estimate of the recovery value of his Article by email in return to the form. The trade-in value is determined based on many criteria. This price is estimated, re-evaluated and validated within 10 working days.

2. PURPOSE

The General Conditions of Service define the contractual conditions of the relationship on the one hand between YUJ Paris and the Member.

3. TERRITORIALITY 

The services of YUJ Paris are reserved for people residing in Europe.

4. USE FOR PERSONAL PURPOSES 

The Site is limited to natural persons and for the personal use of the Items purchased or sold. The Site cannot under any circumstances serve as a support for the exercise of a commercial activity, in any form whatsoever.

5. ITEMS SUBJECT TO EXCHANGES AND PURCHASES 

Only Items corresponding to the families of Items offered may be purchased or exchanged on the Site.

6. OBLIGATIONS OF YUJ PARIS

Except in cases of force majeure, YUJ Paris undertakes to implement all means to provide Members on the Site with access to the pages of the Site and access to the account of each Member.

7. REGISTRATION

The services of YUJ Paris are open to persons duly registered on the Site. This registration is open to anyone of legal age.

The Member undertakes not to communicate his connection identifiers and the Site cannot be held liable if any damage results from the disclosure of his identifiers by a third party. In the event of loss of password, the Member may click on the “forgotten password” link and his identifiers will be sent to him at the email address he provided when registering.

The fact that a Member completes the registration form with one or more erroneous or incomplete data may result in the refusal of registration or the deletion of the account without notice or compensation and without any recourse on the part of the Member.

The Member undertakes to inform YUJ Paris without delay of any unlawful use by third parties of his identifiers.

8. ARTICLE RETURN 

The Site offers a service which takes back the Items in exchange for a credit or a promotional code, open to any registered Member.

1) The Member qualifies his article from the section I sell and obtains an estimated range of its trade-in value by email following the sending of his form. The estimate of the trade-in value is determined according to numerous criteria (type, material, condition, etc.) and is generated automatically. The amount of the credit is confirmed by e-mail within 10 working days from the date of receipt of the article. This amount cannot be the subject of any negotiation with the site. Items without branding or with the branding label cut off are not accepted.

Any Item offered for sale must be in one of the following states:

• Like new - Almost new with no signs of wear
• Very good condition - Only shows minor signs of wear
• Good condition - Some signs of wear but no flaws

Under no circumstances may the Items be in another state (damaged, worn, out of order, stained, perforated, deformed, dirty, cut labels, etc.).

The Member is invited to check that his Items show no defects and comply with the exchange conditions. Failure to comply with these rules may result in the suspension or even deletion of the account.

The Site only includes items whose types and sizes are defined in the list made available on the exchange form.

2) The Member sends the Items via Colissimo:

He uses his own packaging (cardboard, etc.) and prints the dispatch slip sent by the YUJ Paris team if the dispatch is from France or his own dispatch slip if the dispatch is from abroad. He then sticks the delivery slip himself on the package.

3) The Site receives the Articles within 4-5 working days and checks each of the Articles within 10 working days following receipt of the package. The Member receives a summary of the Articles accepted or refused with their recovery values ​​by e-mail to the address he indicated on the Site when registering.

Accepted Items are checked in our Paris-based office and then put up for sale on yuj.fr.

The Site will then take care of the online promotion of the Items which will be offered for sale on various resale channels, in particular on the Site.

4) The Member receives a voucher in the form of an e-gift card or promotional code sent by e-mail. The voucher allows you to receive the fruit of your sale. The Member can keep the voucher to buy Items on the yuj.fr website. If several articles have been accepted, the member will obtain one promotional code per article that can be used on the aigle.com site within the limit of one code per order. If the member wishes to use his credit on the yuj.fr site , he can use all of his credit at once.

5) In the event of an item that is refused, not in conformity with the state declared by the member, non-functional or which is outside the framework of the program, no credit is granted. Refused items will not be returned, they will be donated to an association or may be part of an upcycling process. In the event of a package that is lost or degraded in a proven manner during the transport operation, YUJ Paris cannot be held responsible.

9. PROMOTIONAL CODES

Once the trade-in offer has been validated, the Member can keep the amount credited to purchase Items on the Site or convert it into a promotional code to purchase items on the yuj.fr site.

The promotional codes are valid, until their expiry date, on any order of articles to settle the price of the articles. If the value of the order is greater than the amount of the promotional code, the difference must be paid by the Buyer by one of the other means of payment offered on the site. If several articles have been accepted, the member will obtain one promotional code per article that can be used on the yuj.fr site within the limit of one code per order. If the member wishes to use his credit on the yuj.fr site , he can use all of his credit at once.

The Buyer cannot use several promotional codes to pay for the same order.

A promotional code cannot be used for an order that has already been validated. Any promotional code has an expiration date specified on it. Any promotional code cannot be exchanged or refunded.

10. YUJ CREDIT

Once the trade-in offer has been validated, the Member may keep the amount credited to purchase Items on the Site

Credits are valid on all items offered for sale on the Site.

The Credits are valid, until their expiry date, on any order of articles to pay the price of the articles and the associated delivery costs. If the value of the order is greater than the amount of the credit, the difference must be paid by the Buyer by one of the other means of payment offered on the site.

A credit cannot be used for an order already validated. Any promotional code has an expiration date specified on it. Any Credit cannot be exchanged or refunded.

11. ARTICLE FOR EXCHANGE 

By exchanging an Item, the Member declares:

• Own the Item.
• Have the legal capacity and all necessary authorizations to offer the Item in Exchange.
• Commit contractually to the veracity of the information given.
• Provide all necessary information about the quality and condition of the item
• The Member remains solely responsible for the Exchange of an Article whose circulation will be prohibited, which would contravene the regulations in force, public order and morality.
• Undertake to respect morals, good customs and public order in the description of the Article
• Do not send counterfeit Items: the Site may need to request a certificate of authenticity to verify the information provided by the Member. The Site reserves the right to verify the authenticity of a good and may refuse the Article even if it turns out that the Article is not counterfeit. Members are reminded that offering counterfeit Items is prohibited. Counterfeiting is an offense punishable by law that infringes the intellectual property rights of trademark owners.

The Member must communicate the original copy and/or a copy by electronic means of any element likely to justify the ownership of the Article, its origin, as well as its authenticity on simple request of the Site.

The authenticity of the article is for us its essential quality. In the event of the return of one of your articles, if it is subsequently revealed to us that this quality was lacking, we will consider ourselves victims of an error on the substance within the meaning of article 1110 of the Civil Code.

12. VERIFICATION OF SHIPPING INFORMATION

The home address is required to ship the package.

The Member must ensure that his address is constantly updated. This data will be transmitted to the Carrier under the sole responsibility of the Member.

It is the sole and entire responsibility of the Member to enter correctly and in a complete, real and fair manner the information that will allow the Carrier to proceed with the execution of the shipment of the Item from the sender relay point to the recipient relay point. .

The responsibility of a Member may be sought and engaged if the information entered by himself or by a third party, in particular the postal address and relay point information, is erroneous or false and does not allow the execution of the delivery service by the Carrier.

13. PACKAGING RULES

14. PRINTING OF THE TRANSFER VOUCHER

In order for the article to be authenticated and eligible for trade-in, the member must print the form in order to transfer ownership of the article to YUJ Paris. The form must be in the Member's name and must include the condition of the item and the Member's signature. Otherwise, the form will be null and void.

15. OBLIGATIONS OF MEMBERS

A Member must guarantee the truthfulness and accuracy of the information he provides on the Site, and in particular of his civil status data.

At any time, YUJ Paris may ask the Member to provide proof of the accuracy of their civil status data, by sending a copy of their identity document as well as proof of address (EDF invoice) . Failure to send supporting documents within one month of the request authorizes YUJ Paris to delete the Member's account.

Members must execute the contracts concluded within the framework of the use of the Site in perfect good faith.

A Member must not:

• Offer Counterfeit Items.
• Create more than one account under any circumstances.
• Manipulate or deliberately crash the Site and the billing process.
• Disseminate false information, defamatory, slanderous information, and/or including personal information.
• Transfer their account and credentials to another user.
• Copy, modify or distribute Site content, Site services and tools, and the Site brand.
• Harvest or collect information about Members without their consent or without Site's consent.
• Harvest or collect information about YUJ Paris without the consent of YUJ Paris.
• Hack, modify, damage or destroy Site data and access YUJ Paris data that is not accessible or that is not presented explicitly.
• More generally, using the YUJ Paris Site in bad faith and/or failing to comply with any of the provisions of these general conditions of service.
• Not to post or distribute in any form whatsoever information or content that has the effect of diminishing, disorganizing, preventing the normal use of the services, interrupting and/or slowing down the normal flow of communications between Members through the Services, such as software, viruses, logic bombs, mass mailing, etc.
• Disseminate viruses or any other technology that could harm YUJ Paris, the interests of YUJ Paris Members or their property.

Any breach of these prohibitions may result in the deletion of the Member's account, after formal notice by email to cease the contractual breach that has remained unsuccessful for a period of 7 calendar days from the date the email is sent by YUJ Paris.

YUJ Paris also reserves the right to close Member accounts that have not been confirmed, as well as accounts that have been inactive for more than a year.

16. ORDER

Any Order can only be made when the member has registered on the Site. The member, when logged into his account, can add items to his virtual basket. He can then access the summary of his virtual basket in order to confirm the items he wishes to order and place his Order by pressing the “Order” button.

He must provide an address, a delivery method and a valid method of payment in order to finalize the Order and effectively form the sales contract between him and the Company. The finalization of the Order implies acceptance of the prices of the items sold, as well as the terms and delivery times indicated on the Site.

Once the Order has been placed, the member will receive confirmation by email. This confirmation will summarize the Order as well as relevant information relating to delivery. The placing of an Order constitutes the conclusion of a distance selling contract between the Company and the member.

17. ITEMS AND PRICES

The items subject to the CGV/CGU are those which appear on the Site and which are sold by the Company. The sale takes place within the limits of the Company's available stocks. The latter cannot be held responsible for stock shortages or the impossibility of selling an item whose stock does not exist. 19. DELIVERIES AND RETURNS

Items are delivered exclusively to the following geographical areas:

YUJ Paris undertakes to provide all material and human efforts to have the items delivered as soon as possible. If the delivery deadline of 5 working days is exceeded, except in cases of force majeure, you may request the termination of the contract by registered letter with acknowledgment of receipt, after having instructed YUJ Paris, under the same terms , to make the delivery within a reasonable additional time, and if YUJ Paris has not performed. In this case, you will be refunded within 30 days if a payment has already been made. 20. COMPLAINT

For all Orders made on this Site, you have a right of complaint for 14 days from the delivery of your item. It is your responsibility to check the apparent condition of the items upon delivery. In the absence of reservations expressly issued upon delivery, the items are deemed to comply with the Order. To exercise your right of complaint, you must send to YUJ Paris, at the address sales@yuj.fr, a declaration in which you express your reservations and complaints, accompanied by the supporting documents relating thereto (receipt slip countersigned by the carrier, photographs...). A claim that does not comply with the conditions described above cannot be accepted. YUJ Paris will repair, replace or refund the item or its components as soon as possible and at its expense, subject to the material possibility of repairing the item or its availability in stock.

21. CONSUMER RIGHT OF WITHDRAWAL

You have a right of withdrawal for 14 days from the placing of the Order, except for the items mentioned in Article L.221-28 of the Consumer Code. To exercise your right of withdrawal, you must send a request by e-mail to sales@yuj.fr . Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be remarketed in the condition in which they were sent. They will not be accepted if the article is damaged or not in conformity with the initial state. In the event of exercise of the right of withdrawal within the period referred to above, the price of the item(s) purchased, the shipping costs will be reimbursed. 22. TRANSFER OF RISK AND OWNERSHIP

For Consumer members, the transfer of risk takes place upon delivery.

23. LEGAL GUARANTEES

The items sold on the Site are guaranteed in accordance with the legal provisions of the Consumer Code and the Civil Code as rearticle below:

Article 1641 of the Civil Code:

"The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lesser price for them, if he had known them."

The warranty is limited to the replacement or reimbursement of non-compliant items or affected by an undeclared defect. It is excluded in the event of misuse or abnormal use of the article as well as in the event that the article does not comply with the legislation of the country in which it is delivered. The member must inform the Company of the existence of the defects within two years. The Company will rectify the articles found to be defective as far as possible. If the liability of the Company is retained, the guarantee is limited to the amount excluding VAT paid by the Consumer for the supply of the items. The replacement of items does not have the effect of extending the duration of the guarantee.

24. CHANGES

The Company reserves the right to modify the Site, the CGV/CGU as well as any delivery procedure or other component of the services provided by the Company through this Site.

When an Order is placed, the member is subject to the stipulations set out in the CGV/CGU in force when the Order is placed.

25. PROCESSING OF PERSONAL DATA

31. ACCEPTANCE OF THE CGV/CGU
